Upon the petition a parent, brother, sister, next of kin, or other person interested in the welfare of a minor child, Florida courts may appoint a guardian for a minor child without appointing an examining committee or conducting an adjudicatory hearing. Guardians for minors maintain the same authority as a plenary guardian. Minor guardianships are often necessary in circumstances in which a minor child is party to a lawsuit, or where a minor child is entitled to a large sum of money and cannot otherwise inherit and/or accept said money without the implementation of a minor guardianship or some other vehicle in which to ensure the anticipated funds’ safety.
