When it comes to determining who pays for the cost of divorce, Florida law considers need and ability to pay. What this really means is that the cost of your divorce will be paid from either the income of both spouses, from the income of the greater earning spouse where there is significant disparity, or from marital or non-marital assets. It is important to remember that wherever the costs are paid, that cost affects both parties. Otherwise stated, neither party should waste money fighting about unnecessary or unproductive issues during a divorce. Regardless of who cuts the check, both parties pay.
